PRIVACY POLICY

Your privacy is important to us. Home and Thriving Inc. and its employees, contractors and affiliates (“Home and Thriving”, “HaT”, “we,” or “us”), understand your concerns with regard to how information about you is used and shared, and we appreciate your trust that we will use and share information about you carefully and sensibly. This Privacy Policy describes what information we collect about you, how we collect it, how we use it, with whom we may share it, and what choices you have regarding it. This Privacy Policy is incorporated into and is a part of the Terms of Service of our services, software and products (“Services”). We encourage you to become familiar with this Privacy Policy and our Terms of Service. By accessing and using the Services, you agree that you have read and understand this Privacy Policy and that you accept and consent to the privacy practices (and any uses and disclosures of information about you) that are described in this Privacy Policy.

This Privacy Policy applies only to information collected by these Services. It does not apply to any other services. We are not responsible for, and this Privacy Policy does not apply to, the privacy practices of those other services. We encourage you to seek out and read the privacy policy of each service that you use.

  1. What information do we collect, and how do we collect it?

We may collect certain identifying information from or about you in connection with your use of or submissions to the Services, including, but not limited to, your name, title, street address, company, telephone numbers, email addresses, biometric measurements, food and drink logging, supplement logging, consultation scheduling, and messaging (together, “Collected Information”). In addition, we may retain the content of, and metadata regarding, any correspondence you may have with us or our representatives, regardless of the mode of communication by which such correspondence was made. This information helps us to improve the Services and the online content, materials, and services that we make available through the Services, and to more effectively and efficiently respond to both current and future inquiries.

We also collect information about users for marketing purposes through forms on our website, such as when you request info, sign up for our newsletter, chat with us, request certain educational materials and fill out any other form not mentioned here. We also collect information through other methods found on our website, including emails and phone calls to our business. Information we collect for marketing purposes includes but is not limited to name, email, company, and phone number and this information is held until you choose to opt out, which you may do at any time. We also use third-party data-tracking services like Google Analytics, which tracks which webpage you visited on our website and when.

As with many other services, the web servers used to operate the Services may collect certain data pertaining to you and the equipment and communications method that you use to access the Internet and our Services. For security reasons and to confirm the integrity of the Services, we may combine components of these data with Collected Information, which may identify you. Unless otherwise described in this Privacy Policy or our Terms of Service, such identifying information will be collected and used solely for our business purposes. Also, such identifying information will be collected and used solely in compliance with HIPAA and HITECH regulations and any other applicable laws and regulations. In addition, the information we collect may reveal such things as the Internet protocol (“IP”) address assigned to your computer, specific pages that you accessed through the Services or prior to using the Services, and the length of time you spent using the Services. We may use this information to help administer the Services and the servers that provide the Services, generate statistical information, monitor and analyze the Services’ traffic and usage patterns, and improve the Services’ content and content delivery, including any online content, materials, and services that we describe or make available through the Services.

In addition, our Services may send one or more “cookies” to your computer to improve the utility of the Services by storing user preferences and tracking user trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Please note that you may not be able to access the full functionality of our Services if cookies are disabled on your browser.

  1. How will we use the information you provide to us?

In addition to the uses described above or in our Terms of Service, we may use the information that we collect from or about you to analyze and improve the content, materials, and services that we make available through the Services, to notify you of changes made to the Services, to evaluate user needs and customize the Services’ content delivered to you according to those needs, to send you promotional materials that you request from us, and for other legitimate and lawful business purposes. If you contact us for support or assistance, we may use information about you or your system that you provide or that we collect for purposes such as verifying whether your system meets the minimum requirements needed to use the Services.

We may store Collected Information for as long as needed for the purposes indicated in this Privacy Policy, which are determined by you.

  1. With whom do we share the information we collect?

We may share Collected Information with business and marketing partners in order to provide services to you, and for other lawful business reasons. If all or part of HaT is sold, merged, or otherwise transferred to another entity, we may transfer Collected Information to such entity as part of that transaction.

We may decide from time to time to utilize a number of business and marketing partners in delivering the content, materials, and services available through the Services to you. We may share Collected Information with these business and marketing partners for any lawful purpose, including to communicate with you or to fulfill your requests for our services. We may also produce reports on the Services’ traffic or usage patterns and share these reports with our business and marketing partners and others.

We may disclose Collected Information to the proper authorities if we become subject to a subpoena or court order or if we are otherwise, in the sole opinion of our legal counsel, required to disclose such information. We may also use and disclose information about you to establish or exercise our legal rights, to enforce the Terms of Service, to assert and defend against legal claims, or if we believe such disclosure is necessary to investigate, prevent, or take other action regarding actual or suspected illegal or fraudulent activities or potential threats to the physical safety or well-being of any person

  1. What choices do you have?

When corresponding with HaT or our representatives, or when making a request for information or otherwise interacting with us or others through the Services, you choose what information to supply, what questions or comments to submit, whether you wish to receive further information, and by what method of communication such information should be delivered. Please take care to share only such information as is needed or that you believe is appropriate. You are under no obligation to provide us with personally identifiable information, but without it we may not be able to provide you the products or services you request. You may contact us as indicated below if at any time you would like to ask us about our data collection practices and our information security policy.

 

  1. How do we protect information collected about You?

HaT have in place certain commercially reasonable security measures to protect Collected Information, but the storage and communication of Collected Information can never be completely secure. Hence we do not guarantee that information that you transmit or otherwise supply to us, or any communications conducted through the Services, is or will be totally secure. If you become aware of any breach of the Services’ security, this Privacy Policy, or the Terms of Service, please notify us immediately.

  1. We may change this Notice.

From time to time, we may change our privacy practices, and this Privacy Policy, because of changes in relevant and applicable legal or regulatory requirements, our business practices, or in our attempts to better serve your needs and those of our other customers. Notice of such changes to our privacy practices will be given in the manner described in the Terms of Service and a revised Privacy Policy will be posted through the Services.

  1. Separate agreement.

If you have entered into a separate agreement with HaT with respect to the use of the Services or any Collected Information, that agreement will supersede this Privacy Policy to the extent they are in conflict.

  1. Unsubscribe / Opt-out.

You may unsubscribe from our emails at any time by completing our opt-out form.

The following section describes your information, your rights and the qualified clinician’s responsibilities regarding any interaction you have with any qualified clinician’s consultation scheduled through HaT.

You have the right to:

  • Get a copy of your paper or electronic medical record

  • File a complaint if you believe your privacy rights have been violated

Your Rights

When it comes to your health information, you have certain rights. This section explains your rights and some of our responsibilities to help you.

Get an electronic or paper copy of your medical record

  • You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. Ask us how to do this.
  • We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

Ask us to correct your medical record

  • You can ask us to correct health information about you that you think is incorrect or incomplete. Ask us how to do this.
  • We may say “no” to your request, but we’ll tell you why in writing within 60 days.

Request confidential communications

  • You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.
  • We will say “yes” to all reasonable requests.

Ask us to limit what we use or share

  • You can ask us not to use or share certain health information for treatment, payment, or our operations. We are not required to agree to your request, and we may say “no” if it would affect your care.
  • If you pay for a service or healthcare item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your health insurer. We will say “yes” unless a law requires us to share that information.

Get a list of those with whom we’ve shared information

  • You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why.
  • We will include all the disclosures except for those about treatment, payment, and healthcare operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

Get a copy of this privacy notice

You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly.

Choose someone to act for you

  • If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
  • We will make sure the person has this authority and can act for you before we take any action.

File a complaint if you feel your rights are violated

  • You can complain if you feel we have violated your rights by contacting us using the information on page 1.
  • You can file a complaint with the U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/.
  • We will not retaliate against you for filing a complaint.

Your Choices

For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations described below, talk to us. Tell us what you want us to do, and we will follow your instructions.

In these cases, you have both the right and choice to tell us to:

  • Share information with your family, close friends, or others involved in your care
  • Share information in a disaster relief situation
  • Include your information in a hospital directory

If you are not able to tell us your preference, for example if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.

In these cases we never share your information unless you give us written permission:

  • Marketing purposes
  • Sale of your information
  • Most sharing of psychotherapy notes

In the case of fundraising:

  • We may contact you for fundraising efforts, but you can tell us not to contact you again.

Our Uses and Disclosures

How do we typically use or share your health information?

We typically use or share your health information in the following ways.

Treat you

We can use your health information and share it with other professionals who are treating you.

Example: A doctor treating you for an injury asks another doctor about your overall health condition.

Run our organization

We can use and share your health information to run our practice, improve your care, and contact you when necessary.

Example: We use health information about you to manage your treatment and services.

Bill you for services

We can use and share your health information to bill and get payment from health plans or other entities.

Example: We give information about you to your health insurance plan so it will pay for your services.

How else can we use or share your health information?

We are allowed or required to share your information in other ways – usually in ways that contribute to the public good, such as public health and research. Help with public health and safety issues

We can share health information about you for certain situations such as:

  • Preventing disease
  • Helping with product recalls
  • Reporting adverse reactions to medications
  • Reporting suspected abuse, neglect, or domestic violence
  • Preventing or reducing a serious threat to anyone’s health or safety

Do research

We can use or share your information for health research.

Comply with the law

We will share information about you if state or federal laws require it, including with the Department of Health and Human Services (HHS) if it wants to see that we’re complying with federal privacy law.

Respond to organ and tissue donation requests

We can share health information about you with organ procurement organizations.

Work with a medical examiner or funeral director

We can share health information with a coroner, medical examiner, or funeral director when an individual dies.

Address workers’ compensation, law enforcement, and other government requests

We can use or share health information about you:

  • For workers’ compensation claims
  • For law enforcement purposes or with a law enforcement official
  • With health oversight agencies for activities authorized by law
  • For special government functions such as military, national security, and presidential protective services

Respond to lawsuits and legal actions

We can share health information about you in response to a court or administrative order, or in response to a subpoena.

Our Responsibilities

  • We are required by law to maintain the privacy and security of your Protected Health Information (PHI).
  • We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
  • We must follow the duties and privacy practices described in this notice and give you a copy of it.
  • We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time. Let us know in writing if you change your mind.

Changes to the Terms of this Notice
